Object IND decision

You can object against the IND decision if one of the following applications is rejected:

  • Short-stay visa. Read more on our page Object decision on Schengen or transit visa.
  • Provisional residence permit.
  • Regular permanent residence permit.
  • Regular temporary residence permit or residence permit for a long-term EU resident.
  • Recognition as a sponsor.
  • Application for Dutch nationality.

Waiting for decision on your objection in the Netherlands

Has your application for a regular, temporary or permanent residence permit been rejected? Or has your application to become a long-term EU resident been rejected? The decision says whether you may wait for the decision on your objection in the Netherlands. A decision is an official letter from the IND with the decision on your application.

Are you allowed to wait for the decision in the Netherlands?

Then you can receive a residence endorsem*nt sticker from the IND. A residence endorsem*nt sticker is a sticker in your passport. The sticker is proof that you are allowed to wait for your process in the Netherlands. Make an appointment at the IND desk for a residence endorsem*nt sticker.

What if you are not allowed to wait for the decision in the Netherlands?

This means that you have to leave the Netherlands. Do you want to wait for the decision in the Netherlands? Then you can apply to court for a provisional ruling. You must do this within 24 hours after you have received the decision from the IND. Go to the website of the Judicial System Netherlands (in Dutch: de Rechtspraak) for information about the application for a provisional ruling (only in Dutch).

Steps in the process for objection against IND decision

This involves a number of steps.

  • Step 1. Submit your objection against IND decision

    • Write an objection letter. This is a letter in which you explain why you are objecting to the decision.The letter must contain the following:
      • Your name and address.
      • The date.
      • Which decision you are objecting to.
      • Why you object.
      • Your signature.
    • Send your objection letter together with a copy of the initial decision of the IND to the postal address in the decision. You can also enclose other documents. For example, documents you want to use to explain why you object against the IND decision.
    • Make sure you submit your objection against the IND decision in time. See the decision periods within which you must submit your objection.

    Object decision after your application has been approved

    Has your application been approved, but you disagree with something? For example with the start date of the residence permit? Or with the employment status? Then you can object against the IND decision only after you have collected the residence document from an IND desk. Send your objection against the IND decision within 4 weeks of the date on which you obtained the residence document. Send your objection against the IND decision to the general postal address of the IND.

    Having someone else object against the IND decision

    Are you unable or unwilling to object against the IND decision yourself? Then someone else may also object for you. These persons can object against the IND decision for you:

    • A lawyer.
    • Your legal representative. This is a parent, guardian or someone else who arranges your affairs.
    • A specially authorised person. This is someone to whom you have given permission to object against the decision. State in a letter whom you have authorised and for what you have authorised this person. Sign the letter and enclose it with your objection against the IND decision.
    • If you applied for a residence permit: your (recognised) sponsor.

  • Step 2. Receipt of your objection against the IND decision

    When the IND has received your objection against the IND decision, you or the person you have authorised will receive a letter from us. This letter says on which date we received your objection against the decision. It also states the decision period for your objection against the decision.

  • Step 3. Checking your objection against the IND decision

    The IND checks whether your objection against the IND decision is complete. Are documents missing or are there any incorrect documents? Then the IND will send you a letter. This letter tells you which documents you or the person you have authorised must send. Make sure you do this within 2 weeks.

  • Step 4. Assessment of your objection against the IND decision

    The IND assesses your objection against the IND decision and takes a decision on whether it is well-founded or unfounded.

    Objection against the IND decision well-founded

    The IND has decided that your objection against the IND decision is well-founded. You will receive a positive decision on your objection against the decision. This means, for example, that you will get the visa or the residence permit, or that you will become a Dutch citizen.

    Objection against the IND decision unfounded

    The IND has decided that your objection against the IND decision is unfounded. Your objection against the decision will be rejected. The decision by the IND contains this rejection. If you do not agree with the rejection, you can appeal decision to court.

Appeal to court

Your objection against the IND decision has been declared unfounded. Or your application for a permanent or temporary asylum residence permit has been rejected. Then you can appeal decision to court. Waiting for your appeal in the Netherlands

The decision by the IND will say whether you will be allowed to wait for the appeal process in the Netherlands.

What if you are not allowed to wait for the appeal process in the Netherlands?

This means that you must leave the Netherlands. Do you really want to wait for the appeal process in the Netherlands? Then you can go to a court and apply for a temporary residence permit. You must do this within 24 hours after you have received the decision from the IND.
